Terms and Conditions for Seminars, Courses and Workshops

These terms and conditions apply to all our services linked to the provision of seminars, courses and workshops (each a "Seminar") and shall be deemed to have been accepted when a booking is made for a Tortue Rouge Seminar.

The contract between us

Bookings for Seminars shall be sent to us in writing. If a particular Seminar is already booked up, you will be informed and provided with any alternative available dates. Our written confirmation of a booking brings into existence a legally binding contract between us.

Prices and payment

The prices payable for Seminars are as set out in our website from time to time.

Seminar prices are net prices per participant before VAT (if appropriate). Failure to attend Seminars shall not entitle you to a reduction of the Seminar price. The Seminar price will be invoiced after a booking has been confirmed and must be paid in pounds sterling prior to the commencement of the Seminar. We will not confirm a booking until we have received payment of 15% of the Seminar price.

Cancellation of Seminars

We retain the right to change the content, documentation and duration of Seminars and the venue for Seminars. You may only cancel a confirmed booking by giving written notice to us. If you cancel your booking, we will charge the following cancellation fees:

We retain the right to cancel or postpone a Seminar up to 14 days before the date thereof for technical or economic reasons. You shall be notified immediately and offered, at our discretion, an alternative date/venue or a full refund. All additional claims are excluded.

Copyright and trademarks

All Seminar documents contain information which is protected by copyright. We retain all rights, including to the reproduction of Seminar documents or parts thereof. You shall not reproduce any part of the Seminar documents in any form whatsoever or in particular processed, copied, disseminated or used for public presentation using electronic systems without our prior written consent. Permission is required prior to the use of any recording or photographic equipment. We will on occasion photograph or record training sessions and use images and media obtained for future advertising or promotion. Permission will be sought from Seminar attendees prior to the use of any recording medium. No royalty or other fee will be paid to Seminar attendees and agreement to the recording of images will be taken as acceptance of this condition.

Special needs and requirements

If you have any medical condition that would put yourself or others at risk whilst travelling to or attending a Seminar or have any other special requirements, you must tell us before registering for a Seminar. We will endeavour to accommodate all special needs of which you have advised us.

Liability

This condition shall set out our entire liability (including any liability for the acts or omissions of our employees, agents and sub-contractors) to you in respect of any breach of contract, any use of our services and any representation, statement or tortuous act or omission (including negligence) arising under or in connection with any contract between us. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the services in question. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. With regard to training in rooms and on the property of third parties, we shall not be liable for accidents of participants or loss or damage of their property.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to the contact address of Tortue Rouge International Limited at L’Alabrena, Laval de Nize, 34650 Lunas, France and all notices from us to you will be displayed on our website from to time.

Events beyond our control

We shall have no liability to you for any failure to deliver services or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of these conditions will not be affected.

Third party rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to an agreement to which these terms and conditions apply has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of such agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire agreement

Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
